Myles battles onward
Editor’s Note: Niagara Falls councilperson Donta Myles has launched another volley in his battle against the administration. Here’s his current volley. His proposed resolution and email exchange with acting Corporation Counsel Thomas DeBoy are attached below. Below, verbatim, is a Facebook status from Myles. There is a council meeting Wednesday. Beech Avenue park is on the agenda again.
ENOUGH IS ENOUGH.
I pray that every government official tagged, and every Niagara Falls, NY resident (Especially those who reside in the LaSalle Area) will pay close attention to this post.
Prior to being elected City councilman, I've often asked myself "How did our city find itself in the position it is in?" Nearly 3 years into my term it has become much clearer as to how our city has deteriorated. Toxic Governing!
Below is just one of many examples of how my efforts to represent the best interests of my constituents has been blocked from within government.
Our mayor City of Niagara Falls, NY- Mayor's Office Mayor of the City of Niagara Falls, NY Mr Robert Restaino along with legislative member Chris Voccio held a public hearing meeting in the LaSalle district in regards to the Rat Infestation. This meeting was scheduled on the same date and same time as our scheduled city council meeting, which denied us (the 5 council members) the opportunity to attend and hear the concerns of The People.
I was troubled by that. Why? We are the legislative branch that could sign off on funding that would help resolve this problem that was created by decades of poor decisions made by local government. Was that truly a meeting to address the concerns? Or was it just another box checker?
As councilman, I wanted to address this issue by creating a resolution that would allocate funds from the American Rescue Plan for the extermination of the Rats in the LaSalle Area and possibly the rest of the city. It fits right in with the public safety portion of the ARPA funds. I also asked the Mayor appointed city attorney for his assistance in reviewing the resolution, to make sure that it was accurate for the next city council agenda.
Below is my submission of my resolution, my request for our "Legal Council" to review it, and his response.
I'm still wondering how his "legal opinion" can supersede my ability to submit a resolution. He never sighted the statutes, provisions, nor case law that was violated in my request. And if my memory serves me correct, as the city attorney, it would be his job to suggest those corrections, or make them himself as I requested.
What also bothers me is that I have not received any response from my colleagues.
Maybe our local government needs to be addressed at a State or maybe even Federal level.
