Niagara Falls Police are investigating an officer involved shooting in the 900 block of Niagara Avenue. The shooting occurred around 9:30 p.m. Thursday. Police say that officers were dispatched to the scene for report of shots fired. Once on scene, officers encountered an individual armed with a gun.
Gunfire was exchanged and the armed male was struck. The male was transported to Niagara Falls Memorial Medical Center where he was pronounced dead. None of the officers at the scene were injured.
Falls crime scene and criminal investigation detectives were at the scene. Representatives from the New York State Attorney General's Office also responded to the scene to conduct their investigation, per NYS Law.
The incident remains under investigation. Additional info will be released once it becomes available.

Isn't the BAC limit .08 for commercial drivers? That would mean a .014 way under the NYS limit for BAC. Am I wrong?
